Kahn Pedersen wins important procurement case in the Swedish Supreme Administrative Court

Kahn Pedersen has successfully represented Tekniska verken i Linköping AB in a high profile case in the Swedish Supreme Administrative Court. Kahn Pedersen’s team consisted of Kristian Pedersen, Partner, and Johan Falk, Associate. The key question in the case was to what extent the Swedish legislator has made general principles of EU law applicable to procurements below the EU thresholds and, in particular, to direct awards of contracts not being of cross-border interest. In its judgment, the Supreme Administrative Court finds that the general principles are in fact applicable to such procurements, but that the requirements deriving from the general principles are not to be interpreted as strictly for direct awards as for other the types of procurement procedures.
